Lewisville's rules for empty houses and single-family rentals

Vacant building registration

Under the city's vacant building registration ordinance, a building counts as vacant when nobody lives in it or when the person in it has no legal right to be there. The rule does not apply while the building has an open permit for construction, remodeling or repair. It also does not apply during the first six consecutive months of vacancy if the house is being actively marketed for sale or lease or is under contract. Registrations expire every October 31.

Single Family Rental Inspection Program

The city's rental inspection program has been in effect since July 1, 2008, and the city says no fee or registration is currently required. An inspection can be triggered when the owner or a future tenant notifies the city, when a tenant or owner asks to transfer water service, or when the city receives a complaint. The checklist covers exterior items such as roofing, windows, fences, high grass and standing water. Unless the inspector finds a major life-safety problem, the tenant may move in while minor items are corrected.

Probate and evictions split along different lines. An estate case belongs in the county where the person who died lived, under Estates Code section 33.001. The city's utility service page draws a line that matters on an older or empty house. The city maintains the mains and the service line up to the meter; trouble between the meter and the house is the customer's job.
