Septic and aerobic systems
Oak Point's code regulates on-site sewage facilities, the septic and aerobic systems used where a house is not served by a public sewer. The city's Article 13.02 applies across the incorporated area and adopts the state's rules from the Texas Commission on Environmental Quality. Under section 13.02.003, where a public sanitary sewer is not available, any structure discharging into an on-site system must comply with those rules.
Section 13.02.004 adds local requirements that matter when a house changes hands:
- The owner of any on-site system, regardless of property size, needs a permit to install, construct, alter or repair it.
- The owner of an aerobic or surface irrigation system must file with the city every year either a valid maintenance contract with a TCEQ-certified maintenance provider or documentation that the owner qualifies to maintain the unit, such as TCEQ registration or completed training.
- At least once every four months, the owner of that type of system must file a report showing it was inspected and tested as TCEQ requires.
Section 13.02.008 lets the city's designated representative inspect systems routinely and act on a credible complaint. If your house has an aerobic unit, gather the maintenance contract and recent reports before you list it.
The city sewer bill and the deposit
Section 13.03.002 requires each building within the city's certificate of convenience and necessity for wastewater to be connected to the public sewer in accordance with the city's adequate public facilities policies. Section 13.03.041 defines the city utility bill as the charge for sewer service plus any unpaid balance, service charges and late charges, normally issued monthly. The due date is at least ten business days after the bill is issued, and a payment is past due if it has not reached the administrative services office by the end of business on that date. A mailed payment postmarked on the due date does not count as received on time.
Section 13.03.049 explains the refund: when service is disconnected, the city refunds the deposit plus accrued interest, less any outstanding balance. Moving service from one location to another is not treated as a disconnection.
Grass, trash carts and the city's lien
The current text of Oak Point's nuisance article, Article 6.04, cites Ordinance 2026-04-672, adopted April 15, 2026. Section 6.04.003 makes grass, weeds, brush or unsightly vegetation over 12 inches unlawful on occupied or unoccupied property, with an exception for native wildflowers, pollinator or butterfly gardens and managed native vegetation, as long as they are maintained and do not create a nuisance or harbor rodents or vermin. Section 6.04.008 sets cart rules: carts go to the curbline no earlier than 6 p.m. the evening before collection and no later than 6:30 a.m. on collection day, then back behind the front of the house.
Notice under section 6.04.009 can go to the owner's address in the appraisal district records, and notice given at least one time in any calendar year fulfills the notice requirement. If the owner has not complied within ten days of the notice, section 6.04.010 lets the city do the work. An unpaid bill can become a privileged lien filed with the county clerk under section 6.04.011, second only to tax liens and street improvement liens, with 10% annual interest beginning 180 days after the city pays. Section 6.04.013 adds an administrative fee per occurrence from the code's fee schedule.
Behind on property taxes
Under Tax Code 31.02, taxes not paid before February 1 of the following year generally become delinquent. The county's tax FAQ says real property accounts still unpaid on June 30 of the delinquency year are referred to the delinquent tax attorney with an added 15% to 20% penalty, and that the owner on January 1 stays personally liable for that year's tax even after selling, citing Tax Code 32.07.
The county's delinquent tax sales page calls these sales the last alternative to enforce collections and holds Sheriff's Sales on the first Tuesday of each month at 10 a.m. at the Denton County Courts Building, 1450 E. McKinney Street. Values and deed records
Questions about the appraised value, exemptions or a protest go to the appraisal district, not the tax office, according to the county's appraisal districts page. Denton Central Appraisal District's protest page sets the filing deadline at May 15 or 30 days after the notice was mailed, whichever is later, and lists dated photos and repair estimates among the evidence an owner can bring; Tax Code 41.44 has the protest notice filed with the appraisal review board. Deeds and recorded liens are kept by the County Clerk's Recording Division in Denton.
