Costs and paperwork
What does “we pay all closing costs” cover?
When we buy your house, we pay the closing costs of the sale, including the title company's escrow fee, the owner's title policy and the recording fees. What you owe on the house is different: your loan payoff, any other liens, past-due property taxes and your share of this year's taxes are paid from the price at closing.
Will I know what I walk away with before I sign?
Yes. The title company prepares a closing statement that lists the price, every payoff and every charge, and you see it before you sign. Ask us about any line you don't understand.
Hard situations
Can I still sell if my house is headed to foreclosure?
Often, if the sale closes before the foreclosure sale. Texas holds most foreclosure sales on the first Tuesday of the month, and the lender must post and file a notice at least 21 days before the sale (Texas Property Code 51.002). See selling to stop a foreclosure, and talk to your servicer or a HUD-approved housing counselor about your options.
Can I sell a house I inherited?
Usually, once someone has legal authority to sign for the estate or the heirs. The title company will ask how ownership passed to you. Start with selling an inherited house in Texas, and ask a probate attorney about your case.
We're divorcing. Can we sell the house?
Yes, but both spouses usually have to sign. Texas law says neither spouse may sell the homestead without the other joining in (Family Code 5.001). Read selling a house during a divorce and follow your attorney's advice.
