Little Elm rental permits do not transfer with the house
Little Elm requires a permit for every single-family rental, and that permit does not pass to the next owner. The rules sit in Chapter 22, Article V of the Town's Code of Ordinances, under "Community Integrity Programs." Section 22-141 says:
- Each single-family rental needs its own rental permit, good for the calendar year it was issued.
- The owner files a registration form with the Town by February 15 of each year.
- A permit is not assignable or transferable and covers only the address it was issued for. Whoever buys your rental and keeps renting it will need a permit of their own.
- An owner can cancel a permit by written request and by surrendering it to the director of development services.
- Missing registration costs a late fee of $10 for each month, capped at $50 a year.
Section 22-142 adds a safety inspection. The Town inspects single-family and two-family rentals, inside and out, within 30 days after a new tenant moves in or when a new water account is requested. Violations that are the landlord's to fix must be corrected within ten days of the Town's notice, unless development services approves a work plan. Substandard building orders and the lien they can leave
Article III of the same chapter covers substandard buildings. Before the Town orders a building repaired, closed or removed, section 22-62 calls for a hearing notice to the owner and to any lienholder or mortgagee. Under section 22-66, the order is filed with the town clerk and a notice is published in a local newspaper within ten days.
If the owner does not comply, section 22-69 lets the Town Council have the building closed or demolished and charge the cost to the owner. The assessment notice goes by certified mail to the owner and every lienholder. If it is still unpaid 30 days after notice, the mayor may file a sworn affidavit of the expenses with the Denton County Clerk, which establishes the Town's lien on the lot.
