Denton County or Tarrant County: the offices behind a Flower Mound sale

What the Town's code expects from an empty house
A house often sits empty while it is on the market. The Town's Property Maintenance Standards, in Chapter 14, Article XIII of the Code of Ordinances, include rules written for exactly that. Section 14-541 makes it an offense for the owner or occupant to fail to:
- keep the doors and windows of a vacant structure securely closed so no one can get in;
- keep the inside of a vacant structure free of rubbish and garbage;
- replace broken glass on the outside of the house or any accessory building;
- keep fences in good condition, not propped up or leaned against a pole or piece of lumber for support.
Under section 14-515, a violation that continues more than ten days after notice is a misdemeanor, with a fine of up to $500 per offense. Each day is a separate offense, up to a $5,000 total for one continuing violation, plus court costs.
When the Town does the work itself, the code follows the abatement steps in Chapter 34, Article II, Division 4. The written notice generally allows at least seven days. After the work, the Town sends a demand for its charges. If they are not paid within twenty days, it can file a statement of the charges with the clerk of the county where the property sits, which secures a lien. The charges carry interest at 10 percent a year, and the Town may sue or foreclose to collect. A filed lien turns up in a title search, so ask the Town for a payoff figure early if a crew has ever cleaned up your lot.
If a lender has scheduled a sale
In Texas, a foreclosure auction under a deed of trust is held on the first Tuesday of the month, and notice of the sale must be given at least 21 days before, under Property Code section 51.002. The sale takes place at the courthouse of the county where the land is located, so a Flower Mound house could be auctioned in one of two places:
