Crowley's weed, fence and lien rules
Article III of Chapter 34 of the Crowley city code covers nuisances, and several of its rules land on a house that is empty while it is for sale:
- Twelve inches. Weeds, brush and other uncultivated growth may not pass 12 inches. The duty reaches past the property line, to a point 15 feet outside it or to the curb next to a street or alley.
- Seven days. After an abatement notice is received, the owner has seven days. Then the city may enter, do the work, charge the cost and add an administrative fee from the city's fee schedule.
- Where the notice goes. One allowed method is a letter to the owner's last known address in the records of the appraisal district for the property. If you have moved, update your mailing address with that district.
- Lien. To secure the cost, a statement of expenses is filed with the county clerk. The lien carries ten percent interest, is inferior only to tax liens and street improvement liens, and can be foreclosed.
- Fences. Broken, damaged or missing fence parts must be replaced within seven days of the owner receiving notice. A fence that is not required by a city council order, by zoning or to enclose a pool or spa can be removed within the seven days instead of repaired.
Because the lien statement is filed with the county clerk, ask the city for any balance before you sell.
Closing out your Crowley water account
Crowley's utility rules sit in Article IV of Chapter 86 of the city code. Water service starts with an application and a deposit set in the city's fee schedule. The city holds that deposit until the service is terminated, then refunds it minus anything still owed.
