When an Everman house sits empty
Everman requires owners to register vacant houses. Under Section 4-521 of the city code, a person who owns a vacant building zoned for residential use, or last used as a residence, without a valid certificate of registration commits an offense. The house is presumed vacant 90 days after the earliest of these dates:
- a valid certificate of occupancy expires;
- one or more necessary utilities are disconnected;
- a water bill for the address shows no water usage; or
- the building appears unoccupied on a physical inspection by the city.
The same section lists defenses. Among them: the building was occupied within the 90 days before the alleged offense; it was being renovated, repaired or demolished under any required permits and had been occupied within those 90 days; a fire, flood, storm or other casualty in the prior 60 days left it unable to be occupied, unless the owner, a tenant, an invitee or one of their agents caused that on purpose; or the building official granted a written extension. Registration and inspection fees come from the city fee schedule (Section 4-523). Article XIX sets a fine of up to $2,000, and each day or part of a day a violation continues is a separate offense (Section 4-509). A certificate of registration expires after one year, or earlier when controlling ownership changes, the building becomes occupied or it is demolished, and it cannot be transferred (Sections 4-513 and 4-514). A change of owner calls for a city inspection
Section 4-524, in the same division, applies whether the house is lived in by its owner or rented. The owner must get a certificate of occupancy before a residential structure is occupied again after becoming vacant, and when its ownership changes. Before issuing it, the building official inspects the house and checks it against the minimum building standards in Article IV of Chapter 4.
- The occupant, the owner or the owner's representative must be there for the inspection. When consent to enter is refused or cannot be obtained, the code lets the city seek an administrative search warrant.
- A house found substandard must be brought into compliance within 30 days of the inspection when the building official judges the repairs can be made in that time. If not, the owner applies for a building permit and finishes before the permit expires.
- The owner pays an inspection fee set by the council's fee schedule, plus another fee each time the official is not met at the agreed appointment.
Owning a rental house in Everman
Everman's Article XX, rental property registration requires the owner of each rental unit to register it with the building official before the first tenant moves in, and every year after that (Section 4-534). The certificate costs $20, or an amount later set in the city fee schedule (Section 4-536). It expires one year after issuance, or sooner if controlling ownership changes or the unit stops being used as a rental, and it is not transferable (Sections 4-541 and 4-542).
Registration also needs a current certificate of occupancy. Under Section 4-537, a new one, with its inspection, is due at the earliest of three years after the last one was issued, or within ten business days of converting a property to a rental, acquiring ownership of a new rental unit, or a change in tenant. Before the city issues it, the owner must show that all property taxes on the property are current and that no sanitation or mowing liens are attached. A violation of the article is a Class C misdemeanor with a fine of up to $2,000 (Section 4-533).
